Police national emergency response center at Taraldrud : an analysis of the state's instruments for implementation | Politiets nasjonale beredskapssenter på Taraldrud : en analyse av statens virkemidler for gjennomføring.

Tema for masteroppgaven er politiets nasjonale beredskapssenter på Taraldrud og statens virkemidler for gjennomføring. Oppgaven vil belyse og gjøre rede for bruken av statlig reguleringsplan med tilhørende planprosess, hvordan ekspropriasjonsprosessen har foregått. I tillegg til dette oppgaven se på hvordan grunnervervsforhandlingene. Dette utgjør oppgavens tre fokusområder. Den metodologiske tilnærmingen til fokusområdet statlig reguleringsplan er dokumentanalyse. Dette fokusområdet analyserer planprosessen og bruken av statlig reguleringsplan i tilknytning til politiets nasjonale beredskapssenter. Plassering av beredskapssenteret ble vedtatt 21. oktober 2016. Studien viser at det tok ti måneder fra beredskapssenterets plassering var bestemt til statlig reguleringsplan ble vedtatt. I løpet disse ti månedene var forslag til planprogram ute til offentlig ettersyn og høring, det kom da inn 34 høringsuttalelser. Senere var forslag til statlig reguleringsplan ute til offentlig ettersyn og høring, da kom det inn over 1 000 høringsuttalelser. Dette vitner om et prosjekt som har fått stor oppmerksomhet. Støy, friluftsliv og kritikk av beredskapssenterets plassering temaer som gikk igjen i høringsuttalelsene. Statlig reguleringsplan ble vedtatt med hjemmel i plan- og bygningsloven § 6-4 den 18. august 2017. Dokumentanalyse er også valgt som metodologisk tilnærming til fokusområdet ekspropriasjonsprosess. I studien analyseres ekspropriasjonsprosessens forløp og utvikling i perioden fra februar til desember 2017. Studien viser at det i mars 2017 ble sendt ut forhåndsvarsel om mulig ekspropriasjon. I juli 2017 ble det første ekspropriasjonsvedtaket for to av eiendommene truffet og fire måneder senere, i november 2017, ble det truffet ekspropriasjonsvedtak for de øvrige eiendommene. Det ble også sendt ut forhåndsvarsel om forhåndstiltredelse i november 2017, drøyt en måned senere ble det fattet vedtak om forhåndstiltredelse. Analysen avdekker at ekspropriasjonsprosessen utviklet seg raskt, det tok åtte måneder fra første forhåndsvarsel om mulig ekspropriasjon til det var truffet vedtak om ekspropriasjon av alle eiendommene. I tillegg har tvangsmiddelet forhåndstiltredelse blitt benyttet i denne saken. Ekspropriasjonsvedtakene har blitt begrunnet med prosjektets tidspress og at prosjektets fremdriftsplan skal overholdes. Til det tredje fokusområdet grunnervervsforhandlingene har kvalitativt intervju blitt benyttet som metodologisk tilnærming. I den forbindelse ble det gjennomført tre intervjuer med personer som hadde vært involvert i grunnervervsforhandlingene på Taraldrud. Intervjuutvalget besto av en grunneier, en rådgiver som hadde bistått grunneierne i forhandlingene og en representant fra Justis- og beredskapsdepartementet. Analysen av dette momentet søkte å finne intervjupersonenes erfaringer og opplevelser av grunnervervsforhandlingene. Studien viser at partene ikke kom frem til minnelig avtale som følge av uenigheter ved verdifastsettelsen for noen av eiendommene. Studien avdekte også at tidspress og prosjektets fremdriftsplan, kombinert med stor avstand mellom partene var avgjørende for at det ble fattet ekspropriasjonsvedtak. Alle intervjupersonene kunne også fortelle at det hadde vært krevende forhandlinger.

إنجليزي. The theme of this master's thesis is the Police national emergency center at Taraldrud and the state's instruments for implementation. The thesis will elucidate and explain the use of state regulation plan and associated planning process, how the expropriation process has taken place. The thesis will also look at the land acquisition negotiations. This constitutes the three focus areas of the assignment. The methodological approach to the focus area state regulation plan is document analysis. This focus area analyzes the planning process and the use of state-owned government plans in connection with the police national emergency response center. The placement of the emergency response center was adopted on 21 October 2016. The study shows that it took ten months from the emergency center's location, if decided to state regulation plan was adopted. During these ten months, draft plans were available for public inspection and consultation, and 34 hearing statements were issued. Later, proposals for state regulation were available for public inspection and consultation, when more than 1 000 consultation statements were received. This testifies to a project that has received much attention. Noise, outdoor life and criticism of the preparedness center's location themes that went back in the hearing statements. Government regulation plan was adopted on the basis of the Planning and Building Act section 6-4 on 18 August 2017. Document analysis is also chosen as a methodological approach to the focus area expropriation process. The study analyzes the process of expropriation process and development during the period from February to December 2017. The study shows that in March 2017, advance notice was sent on possible expropriation. In July 2017, the first expropriation decision for two of the properties was taken and four months later, in November 2017, an expropriation decision was taken for the other properties. An advance warning was also issued in November 2017, just over a month later, a decision was taken on pre-accession. The analysis reveals that the expropriation process developed quickly, it took eight months from the first advance notification of possible expropriation until a decision was taken on expropriation of all properties. In addition, the pre-emptive coercive measure has been used in this case. Expropriation decisions have been justified by the project's time pressure and that the project's progress plan must be respected. For the third focus area, land acquisition negotiations, have qualitative interview been used as a methodological approach. In this connection, three interviews were carried out with persons who had been involved in the basic sales negotiations at Taraldrud. The interview selection consisted of a landowner, a counselor who had assisted the landowners in the negotiations and a representative from the Ministry of Justice and Emergency Affairs. The analysis of this moment sought to find the interviewees' experiences and experiences of the baseline negotiations. The study shows that the parties did not arrive at a memorable agreement due to disagreements on the valuation of some of the properties. The study also revealed that time constraints and the project's progress plan, combined with a large distance between the parties, were decisive for the adoption of expropriation decisions. All interviewees could also tell that there had been demanding negotiations.
