İSLÂM’DA YARALAMA VE ÖLÜME SEBEBİYET VERMELERDE DİYET, ERŞ VE TA’ZİR CEZALARI | DIYYA, ERSH AND TAZIR DUES IN THE INJURY OR DEATH CLAIMS IN ISLAM

İslâm’da mal, can, ırz, akıl ve inanç özgürlüğü olmak üzere beş şey güvence altına alınmıştır, bunlara bilerek veya bilmeyerek zarar verenler için de çeşitli yaptırımlar konulmuştur. Diğer yandan İslâm Devleti de maslahat ve kamu yararını dikkate alarak, had cezalarını geçmeyen ölçüde cezalar koyabilir bunlara da ta’zir cezası denir. Kur’an-ı Kerim'in çeşitli ayetlerinde insanlara karşı haksızlık edenler için büyük bir azap olduğu bildirilmiştir. Bir kimseyi yanlışlıkla öldürmenin cezası olarak ölenin mirasçılarına diyet ödenmesi ve mü’min bir köleyi azat etmesi bunlar arasında sayılabilir. Kasten öldürmekten doğan diyetin ise, mala verilen zararlarda olduğu gibi suçu işleyen tarafından ödenmesi şahsi sorumluluk gereğidir. Bir de fail-i meçhul cinayetlerde, suçun meskûn bir alanda işlenmesi halinde, mağdurun yakınlarının isteği üzerine, çevreden seçilen elli kişinin sorgulanarak, kasâme denen yemine davet edilmesi, "Biz öldürmedik ve öldüreni de bilmiyoruz" diye yemin etmeleri halinde, diyet tazminatı ile sorumlu tutulmaları, o bölge halkının ilgi ve dikkatsizliğine bir çeşit ceza olarak değerlendirilir. Hata ile ölüme sebebiyet vermelerde, yalnızca diyet gerekir, yaralama veya bir organı sakat bırakma gibi fiillerde ise mağdura verilmesi gereken bedele “erş” denir. Diyet sözcüğü, bazen erş yerinde de kullanılmaktadır. Bu çalışmada, İslâm’da kul hakkı, yaralama ve ölüme sebep olma gibi durumlarda ortaya çıkan tazminat (erş ve diyet) hakkı ve buna ilişkin devlet güvencesi, kısas, kasâme ve ta’zir cezası gibi konular ele alınarak kısaca değerlendirilmiştir.

Five things have been guaranteed in Islam, namely the freedom of property, life, chastity, mind and belief, and various sanctions have been imposed on those who harm those intentionally or unintentionally. On the other hand, the Islamic State may also inflict nemesis up to not exceeding hadd penalties, taking into account of the public interest and/or public welfare. These are called tazir punishments. In various verses of the Qur'an, it is stated that there is a great punishment for those who do injustice to people. Payment of diyya (blood money) to the heirs of victim and emancipation of a Muslim slave are listed among these. Also, in case of unidentified murders, if the crime is committed in a residential area, at the request of the relatives of the victim, holding responsibility of fifty people who selected from the neighborhood with the diyah compensation, if they swear by saying"We did not kill and we do not know who killed," after inviting them to take an oath called Qasama, is considered as a kind of punishment for the apathy and carelessness of the local community. In case of accidental killings, only diyya is required, and in acts such as injuring or debilitating of an organ, the price to be paid to the victim is called "ersh". The word diyya is also sometimes used in place of ersh. In this study, the rightful due in Islam, the right of compensation (ersh and diyya) arising in cases such as injury and death and the related state guarantee, and the issues such as qisas, qasama and tazir punishment were discussed.
