This resettlement action plan (RAP) comprises eight volumes covering related issues for each project area, and includes as well, the policy framework for resettlement compensation (v. 8) that ensures compliance with the legal and regulatory framework, eligibility criteria, and modes of compensation that will guide the resettlement process. The RAP stipulates that compensation for losses due to temporary acquisition of agricultural, and forest land in the right of way (ROW), will be in the form of cash at replacement costs for crops at market prices, with no land compensation. In addition, regarding partial building structure losses in the ROW, subject to the conditions under Article 8 of Decree no. 54/1999 on the protection of high voltage networks, the project affected people (PAP) may choose to 1) remain in their homes, and will be subsidized for losses; or, 2) be compensated in cash at substitution costs. PAPs who suffer total losses of both land, and building structures will be compensated, either in the form of land at replacement costs, or, land for land compensation, with additional cash compensation at replacement costs covering affected assets, including crops, and fruit trees at replacement costs. Allowances include relocation assistance for a six month period, in the form of food security, i.e., rice provisions; transportation allowances; and, rehabilitation assistance following business, or income losses over 25 percent of income. Grievance mechanisms include commune authorities, who may present cases to the District People's Committee, revised by the Provincial People's Committee, and if need be, may be submitted for consideration of the District Court.
