أثر الرقابة القضائية على تحسين جودة القرارات الإدارية من وجهة نظر العاملين في الدوائر القانونية بالمؤسسات الحكومية بالمحافظات الجنوبية الفلسطينية | The impact of judicial control on improving the quality of administrative decisions from the point of view of officials working in the legal services of government institutions that operate in the southern Palestinian governorates

This study aimed to disclose the impact of judicial oversight on improving the quality of administrative decisions from the point of view of employees working in legal departments at the government institutions in the southern Palestinian governorates. The study population consisted of (165) workers in legal departments at the government institutions, the comprehensive inventory method was used, (119) were recovered for the purposes of analysis, with a recovery rate of (72.1%), in addition to conducting (20) interviews with lawyers, human rights organizations and judges. The study reached a set of results, the most important were: There is a positive correlation between judicial oversight and the quality of administrative decisions,where the value of the Pearson correlation coefficient was (0.423), with a level of significance (0.000) less than (0.05), in addition to the existence of a statistically significant effect of judicial oversight in its dimensions in the study: (Cancellation control for illegality and Cancellation control for inadequacy) on improving the quality of administrative decisions from the point of view of Employees working in the legal departments of government institutions in the southern Palestinian governorates asthe regression coefficient reached (0.565). The study also found that there were no statistically significant differences in the average response of the respondents due to demographic variables (gender, age, educational qualification, job title, years of experience) about the variables of judicial control and the quality of administrative decisions. The study concluded with the recommendation to the Palestinian governmental institutions that it is necessary to develop a clear and an objective strategic plans to enhance the commitment of the Palestinian institutions with the supervisory procedures and the application of the instructions issued by the judicial oversight; to enhance the ability of institutions to increase the transparency, credibility and reliability of their decisions, and thus strengthening bridges of trust between them and the Palestinian society. The Study also recommended the Palestinian government with the necessity of granting judicial oversight to government institutions the independence to enhance their powers in a more robust and necessary manner in order to enhance their ability to harmonize administrative decisions with laws and legislation; that can give legal status to these decisions, and thus provide the necessary legal support for their implementation.
