Study on present situation and problems of each fisheries managements among China, Korea and Japan

Ten years have passed from the United Nations Convention on the Law of the Sea (UNCLOS) coming into effect in 1994. Korea, China, and Japan ratified the UNCLOS in 1996, simultaneously, and then each country started negotiation to establish the Fisheries Agreements. And they are groping for the fisheries management system that suits it under new fisheries order. This paper hits the focus to the Fisheries Managements among Japan, Korea, and China, especially about Fisheries Agreements. And it clarifies each common point, difference point and the distinctive feature of these. It also analysis present situation of the mutually using of fisheries. Fisheries Agreement between Japan and Korea was enacted in 1999, between Japan and China in 2000, and between Korea and China in 2001. Some remarkable characteristics of Fisheries Agreements are as follows, (1) Open access zone of both countries was set because each EEZ overlapped and also because of the territorial issue. (2) Mutual entry to the EEZ (Exclusive Economic Zone) was taken. In the open access zone, fishing regulations and law enforcement is carried by the flag country and in the EEZ, it is carried by coastal country. On the entry to the EEZ, granted catch volume to foreign boats are gradually cut down. As a result, fishery country that has stronger power of fishery is eliminated out of EEZ and move into the open access zone.
