At the present time, numerous specialists from various fields and subject areas are endeavouring, together with the interest groups concerned at the time, to further the development of the legislation concerning a sustainable use of land resources. In the course of this, fundamental questions and significant points of view all too often go by the board or are pulled apart on account of party politics. In the end, whether it be the landscape, the soil, the forest or the environment, it does not primarily come down to a restriction of private property in favour of public welfare, which is always difficult to define. Rather it means a sensible delimitation between liberty- and ownership-restrictive general protection rights, and property-protective and ownership-advantageous general exploitation rights. It will be decisive for the continuing existence of an overall economic and ecological coherence that sensible definitions be found for each part of the whole. These should, without ruining the totality, judiciously isolate goods, property and subject areas and put them into a freedom-friendly superior framework. Thus the comprehensive control over private property can be brought into harmony with the responsibility for a common heritage covering all generations.
