Mechanism of state regulation of the process of commercialization of intellectual property objects

В настоящее время одной из главных проблем науки и инноваций являются разрывы в инновационном цикле, которые образуются при переходе от фундаментальных исследований через научно-исследовательские и опытно-конструкторские работы (НИОКР) к промышленному использованию. В связи с этим в условиях формирующейся в Беларуси экономики знаний на первый план выходит задача трансфера и коммерциализации НИОКР. Трансфер и коммерциализация технологий является важнейшим направлением, которое способствует эффективному использованию потенциала отечественной аграрной науки, а также призвано обеспечить выход на новые рынки технологий. На современном этапе научные учреждения, в том числе аграрного профиля, отдельные ученые и изобретатели сталкиваются с проблемой определения перспективных направлений коммерциализации результатов интеллектуальной деятельности, а также выбором пути продвижения на рынок и коммерциализации результатов НИОКР. В связи с этим особую актуальность приобретает необходимость формирования механизма регулирования процесса коммерциализации объектов интеллектуальной собственности, созданных за счет государственных средств. Рассматриваются вопросы правового регулирования процесса коммерциализации объектов интеллектуальной собственности, созданных за счет государственных средств. Предложена комплексная модель процесса коммерциализации результатов научной и научно-технической деятельности, которая наглядно детализирует все этапы данного процесса. Особое внимание уделено срокам и последовательности передачи результатов НТД между субъектами до полного завершения процесса коммерциализации. Использование предложенной комплексной модели позволит учреждениям аграрного образования, участвующим в процессе коммерциализации, структурировать данный процесс на отдельные этапы и прогнозировать различные варианты его успешного развития.

Currently, one of the main problems of science and innovation are the gaps in the innovation cycle, which are formed in the transition from basic research through research and development to industrial use. In this connection, in the emerging knowledge based economy in Belarus there comes to the fore the problem of transfer and commercialization of research and development. Transfer and commercialization of technology is the most important area, which contributes to the efficient use of the capacity of the national science and is intended to ensure access to new technology markets. At present, the academic institutions, individual researchers and inventors are faced with the problem of identifying promising areas of commercialization of intellectual property, as well as the choice of ways to market and commercialization of research and development results. In this connection, of special importance is the need to form the mechanism of regulation of the process of commercialization of intellectual property created at the expense of public funds. The legal regulation of commercialization of intellectual property created at the expense of public funds was considered. A comprehensive model of commercialization of scientific and technological activities results, which clearly details all the stages of this process, was proposed. Particular attention is paid to the timing and sequence of distribution of results of scientific and technological activity between subjects until the completion of the commercialization process. The use of the proposed integrated model will allow actors involved in the process of commercialization, to structure the process into separate stages and to predict a variety of options for its successful development.
