Agricultural Nuisances and Right to Farm Laws

The expansion of residential areas may result in an agricultural facility becoming a nuisance. Forty-four states have enacted right to farm laws to assist in preserving farm land from encroaching nonagricultural uses. Major legislative provisions of these state laws are identified along with several policy considerations concerning competing property interests.
