Opsjonsavtaler : når eiendomsutvikleren sitter på rettighetene | Option contracts : when the property developer holds the rights

The topic of this master’s thesis is option contracts, and whether these contracts can affect the planning processes in the municipality regarding which areas are prioritized for re-regulation. The main research topic for the thesis is: Are areas where option contracts exist prioritized over other areas of development? Option agreements are typically made between property developers and landowners, where the property developers wish to secure the rights to buy a property in the future. Previous studies have been carried out on various research topics from the perspective of landowners and property developers. This thesis will explore the relationship between the option contracts and the planning authorities’ planning processes. Through the research topics, theory, and interviews of representatives from the planning department in municipalities as empirical data, the thesis shall shed light on the planning authorities’ perspective on the option contracts. First through the theory in chapter 3, on to empirical data in chapter 4 and discussions and conclusions in chapter 5. The thesis shows that it is largely property developers who take the initiative to develop areas in Norway. Whether the option contracts affect the prioritization of areas will depend on the influence on politicians and the relationship between projects and the municipal plans.

Tema for masteroppgaven er opsjonsavtaler, og hvorvidt disse avtalene kan påvirke planprosessene i kommunen med tanke på hvilke områder som blir prioritert for omregulering. Hovedproblemstillingen til oppgaven er: Blir områder hvor det foreligger opsjonsavtaler prioritert foran andre områder for utvikling? Opsjonsavtaler inngås typisk mellom eiendomsutviklere og grunneiere, hvor eiendomsutviklerne ønsker å sikre seg rettighetene til å kjøpe en eiendom frem i tid. Det har tidligere vært forsket på ulike problemstillinger sett fra grunneiernes og eiendomsutviklernes perspektiver. Denne oppgaven vil gå nærmere inn på sammenhengen mellom opsjonsavtalene og planmyndighetenes planprosesser. Gjennom problemstillingene, teori og intervju av representanter fra planavdelingen i kommuner som empiri, skal oppgaven belyse planmyndighetenes perspektiv på opsjonsavtalene. Først gjennom teorien i kapittel 3, videre til empiri i kapittel 4 og drøftelser og konklusjoner i kapittel 5. Oppgaven viser at det i stor grad er eiendomsutviklere som tar initiativ til å utvikle områder i Norge. Hvorvidt opsjonsavtalene har innvirkning på prioritering av områder vil avhenge av påvirkning på politikere og forholdet mellom prosjekter og kommuneplanens samfunnsdel og arealdel.
