La huella hídrica como forma adoptada para el canon de uso del agua en la provincia de Buenos Aires

Partiendo del marco jurídico que regula el dominio del agua desde el Código Civil, hasta el nuevo Código Civil y Comercial y las disposiciones constitucionales, donde las provincias detentan el dominio de los recursos naturales que les asigna la potestad para regular su manejo, se analiza la normativa del Código de Aguas de la Provincia de Buenos Aires, que establece el régimen de protección, conservación y manejo del recursos hídrico. En este se prevé el pago de un canon para los concesionarios o permisionarios de derechos de uso del agua pública, que se instrumentó a través del Decreto 429/13 mediante el concepto de huella hídrica, y que al momento sólo se ha aplicado para el uso extractivo o consuntivo del agua, lo que motivara su impugnación judicial, analizándose en el presente dos fallos dictados ante esas acciones.

Starting from the legal framework that regulates the water domain from the Civil Code to the new Civil and Commercial Code and the constitutional provisions where the provinces hold the domain of natural resources that assign them the power to regulate their management, the regulations of the Water Code of the Province of Buenos Aires are analyzed, which establishes the regime of protection, conservation and management of water resources. This provides for the payment of a fee for concessionaires or permit holders of public water use rights, which was implemented through Decree 429/13 through the concept of water footprint, and which at the moment has only been applied for the use of water. extractive or consumptive of the water, which will motivate its judicial challenge, analyzing in the present two faults distant before those actions.
