2022
Jie HONG | Zhaobin PEI
In recent years, the number of fishery operations groups in China has increased significantly, and at the same time, violations of fishing permits to jointly manage fishing areas have become increasingly serious. There are clear definitions in the "Fisheries Law" and related fishery legislation, but there is no specific description of legal responsibilities, which seriously affects the normal order of fishery activities and the sustainable development of fishery resources. Based on the status quo of violating fishing permits to jointly managed fishing areas, combined with relevant provisions of the Fisheries Law, the paper analyzed the necessity and feasibility of adding legal liabilities, and put forward the suggestions of perfecting the relevant legal liability and refining the responsibility, applying a more severe punishment, increasing the cost of illegal, etc.
