Origen y fuente constitucional de los derechos de la naturaleza en Chile. Una perspectiva desde la lógica ambiental del agua

El presente artículo pretende dilucidar si la normativa constitucional chilena da cabida a la existencia y soporte de aquellas titularidades que la doctrina del derecho comparado ha denominado derechos de la naturaleza. De la consagración constitucional del deber del Estado de tutelar la preservación de la naturaleza–concebido como una obligación independiente al imperativo de velar para que el derecho humano a vivir en un medio ambiente libre de contaminación no sea afectado– ha venido surgiendo el reconocimiento jurisprudencial de un derecho correlativo autónomo, cuya finalidad es la supervivencia de los ecosistemas. Estos derechos –a los que indistintamente denominaremos derechos ecológicos– han venido cuajándose, tímidamente, en las manos de los jueces al amparo del principio precautorio. Es así como este deber de tutelar la preservación de la naturaleza abandona ese letargo y comienza a manifestarse en el entorno jurídico con repercusiones directas en el cuidado preventivo y en la restauración de la naturaleza, especialmente en materia de aguas.

The present article intends to elucidate if the Chilean constitutional regulation allows for the existence and support of those entitlements that the doctrine of comparative law has denominated Rights of Nature. From the constitutional consecration of the duty of the State to protect the preservation of nature – conceived as an independent obligation to ensure that the human right to live in a pollution-free environment is not affected – the jurisprudential recognition has been emerging of an autonomous correlative right, whose purpose is the survival of ecosystems. These rights, which we indifferently call ecological rights, have timidly been curdled from the hands of judges under the precautionary principle. Becoming a State´s duty to protect the preservation of nature, is the way this right abandons it´s lethargy and begins to manifest itself in the legal environment with direct repercussions on preventive care and on the restoration of nature, especially in matters of water issues.
