Heterologous assisted human reproduction techniques considering bioethical principles | Las técnicas de reproducción humana asistida heterólogas a la luz de los principios bioéticos

Purpose/Context. The main purpose of this article is to investigate the bioethical background of the norms that regulate heterologous assisted human reproduction techniques in Argentine Republic. Methodology/Approach. The methodology used consists of the analysis of current and projected national regulations considering the bioethics principles. It starts from an approach of the multiple implications of identity as a fundamental human right to then investigate if the legal norms are consistent with the classic bioethical principles: autonomy, beneficence, non-maleficence and justice. Results/Findings. As a result of the investigation, we consider the need to differentiate two autonomous is sustained: the determination of the filial bonds and the right of the person born to know the identity of the person who has contributed the genetic material. In this last sense, we propitiate an interpretation aimed at making this right effective is encouraged. Discussion/Conclusions/Contributions. The main contribution of the article is to show the relevance of the topic. It is concluded that the only interpretation that is consistent with bioethical principles is the one that weighs the right to identity of the person born above others. Finally, a legislative reform is promoted in this sense.

Propósito/Contexto. Este artículo tiene como propósito principal indagar en el trasfondo bioético de las normas que en la República Argentina regulan las técnicas de reproducción humana asistida heterólogas. Metodología/Enfoque. La metodología utilizada consiste en el análisis de la normativa nacional vigente y proyectada a la luz de los aportes de la bioética. Se parte de un enfoque de las múltiples implicancias de la identidad como derecho humano fundamental para luego indagar si las normas jurídicas se condicen con los principios bioéticos clásicos: autonomía, beneficencia, no maleficencia y justicia. Resultados/Hallazgos. Como resultado de la investigación, se sostiene la necesidad de diferenciar dos autónomos: la determinación de los vínculos filiales y el derecho de la persona nacida a conocer la identidad de quien ha aportado el material genético. En este último sentido se propicia una interpretación encaminada a efectivizar este derecho. Discusión/Conclusiones/Contribuciones. La contribución principal del artículo es poner en evidencia la relevancia del tema. Se concluye que la única interpretación que se condice con los principios bioéticos es la que pondera el derecho a la identidad de la persona nacida por encima de otros. Finalmente, se propicia una reforma legislativa en tal sentido.
