Purpose. Analyse errors that the parties make in documents on the transfer of rights to plant varieties with incorrect application of the applicants and the authors of the grade of the current legislation in terms of drafting an application for a plant variety and its annexes; organizing and developing practical recommendations when concluding agreemens for transfer of rights to plant varieties. Results. It was found that current legislation envisages the conclusion of only two types of contracts in the field of plant variety rights, which are not fully secured the rights and interests of the parties. The conclusion of the contract on the transfer of the right to file the application for a plant variety is a means to protect the rights of applicants and the basis for accepting it by the authorized body. Conclusions. Preparing error-free application documents facilitates rapid conducting a formal examination and adoption of a positive decision for the applicant. Proper registration of labor agreements between the breeder (author) and the employer contributes to the protection of the rights of each of the parties to such agreements. | Цель. Проанализировать ошибки, которые допускают стороны в документах о передаче прав на сорта растений при неправильном применении заявителями и авторами сорта норм действующего законодательства в части составления документов заявки на сорт растения и приложений к ней; упорядочить и разработать практические рекомендации при заключении сделок о передаче прав на сорта растений. Результаты. Обнаружено, что дейст­вующим законодательством предусмотрено заключение только двух видов договоров в сфере охраны прав на сор­та растений, которыми не полностью обеспечиваются права и интересы сторон. Выявлено, что действующим законодательством закреплено неисчерпаемый перечень видов сделок относительно распоряжения имущественными правами интеллектуальной собственности. В группу договоров относительно распоряжения имущественными правами интеллектуальной собственности отнесено лицензию на использование объекта права интеллектуальной собственности. Законодательством предусмотрено три вида лицензионных договоров на условиях исключительной, неисключительной и единичной лицензии. Результатом заключения лицензионного договора является предоставление имущественных прав интеллектуальной собственности во временное пользование без потери правообладателем прав на этот объект. Выводы. Правильное оформление лицензионных договоров между лицензиатом и лицензиаром способствует защите прав каждого из участников таких договоров. Лицензиат будет иметь законные основания использовать сорт, лицензиар сможет получать вознаграждение за предоставленное право пользоваться сортом. | Мета. Виявлено, що чинним законодавствомзакріплено невичерпний перелік видів угод щодо розпоряджання майновими правами інтелектуальної власності. До групи договорів щодо розпоряджання майновими правами інтелектуальної власності віднесено ліцензію на використання об’єкта права інтелектуальної власності. Законодавством передбачено три види ліцензійних договорів на умовах виключної, невиключної та одиничної ліцензії. Результатом укладання ліцензійного договору є надання майнових прав інтелектуальної власності на тимчасове користування без втрати правовласником прав на цей об’єкт. Висновки.Правильне оформлення ліцензійних договорів між ліцензіатом та ліцензіаром сприяє захисту прав кожного з учасників таких угод. Ліцензіат матиме законні підстави використовувати сорт, ліцензіар зможе отримувати винагороду за надане право користуватися сортом.

Purpose. Investigation of peculiarities of water consumption of oat varieties at different sowing dates under the conditions of insufficient and unstable moistening in the northern part of the Steppe zone of Ukraine. Methods. Field, statistical, synthesis methods. Results. It was determined that Skakun variery has used the maximum amount of water not only at optimal sowing date but also in case of its shifting that was caused by its longer growing season. Total water consumption during the growing season was 3189–2826 m3/ha. Kubanskyi variety has used the smallest amount of water – 2976 m3/ha in case of optimal sowing date and 2632 m3/ha when sowing date was shifted by 15 days. Synelnykivskyi 1321 variety in terms of total water consumption occupied an intermediate position between the estimated varieties – it has used 3069 m3/ha moisture at optimal sowing date and 2,732 m3/ha in case of its shifting by 15 days. Conclusions. In the northern part of the Steppe zone of Ukraine, effective use of available moisture is determined by the capacity of some varieties to adapt to growing conditions with unfavourable water regime. Synelnykivskyi 1321 variety was the most drought-resistant one among evaluated varieties. Skakun variety had average drought-resistance. Optimal sowing date is the most suitable for this area. Later oat planting resulted in reducing of total water consumption and increasing of water-use ratio. Moisture can be consumed by oat the most effectively in case of optimal sowing date and higher level of natural water supply. | Цель. Исследовать особенности водопотребления сор­тов овса в условиях недостаточного и нестабильного режима увлажнения северной части Степи Украины Методы. Полевой, метод синтеза, статистический. Результаты. Установлено, что максимальное количество влаги использовал сорт Скакун при посеве в оптимальные сроки и при их смещении, что обусловлено его более длительным вегетационным периодом. Суммарное водопотребление за вегетационный период у него составляло 3189–2826 м3/га. Наименьшее количество влаги использовал сорт Кубанский – 2976 м3/га при оптимальном посеве и 2632 м3/га – при посеве со смещением на 15 суток. Сорт Синельниковский 1321 по уровню суммарного водопотребления занимал промежуточное положение среди изучаемых сортов – он потреблял 3069 м3/га влаги при посеве в оптимальные сроки и 2732 м3/га – при смещении его на 15 суток. Выводы. В условиях северной части Степи Украины эффективное использование имеющейся влаги определялось способностью некоторых сортов лучше адаптироваться к неблагоприятным по водному режиму условиям выращивания. Сорт Синельниковский 1321 является наиболее засухоустойчивым среди оцениваемых сортов. Среднезасухоустойчивым оказался сорт Скакун. Оптимальные сроки посева являются наиболее благоприятными для этой зоны. Посев овса в более поздние сроки приводил к уменьшению суммарного водопотребления и повышению коэффициентов водопотребления. Наиболее рационально влага расходуется при посеве овса в оптимальные сроки и в условиях более высокого природного влагообеспечения. | Мета. Methods. Field, laboratory, statistical ones. Results. Since varietal characteristics can greatly influence the course of the growth process, the experiment included phenological observations of plants growth and development, biometric measurements of plants and fruits, productivity records, besides, biochemical values of fruits with various shape were defined (flat-round and plum-shaped fruits). Varieties with the highest yield, best biochemical values and earlier fruit ripening were identified. Conclusions. Among the samples of tomato with flat-round fruits, Zoren variety had the shortest time interval from mass germination up to early ripening of fruits, Myroliubivskyi variety – in the group of plum-shaped fruits. In the first group Atlasnyi variety had the highest yield, in the se­cond – Khoriv variety. Atlasnyi (flat-round fruits) and Oberig (plum-shaped fruits) varieties had the best biochemical values. Varieties with plum-shaped fruits excelled samples with flat-round fruits at biochemical composition. | Цель. Проведение сравнительной оценки сортов помидора селекции Киевской опытной станции Института овощеводства и бахчеводства (ИОБ) НААН с учетом разной формы плода. Методы. Полевой, лабораторный, статистический. Результаты. Поскольку сортовые особенности могут значительно влиять на прохождение ростовых процессов, в опыте проведены фенологические наблюдения, биометрические измерения растений и плодов, учет урожайности, определены биохимические показатели плодов с разной формой (плоскоокруглой и сливовидной). Выделены сорта с наиболее высокой урожайностью, с более ранним созреванием плодов. Выводы. Среди образцов помидора с плоскоокруг­лыми плодами самый короткий период от массовых всходов до начала созревания плодов имел сорт Зорень, в группе со сливовидной формой – Миролюбовский. Самую высокую урожайность в первой группе обеспечил сорт Атласный, во второй – Хорив. Лучшими биохимическими показателями характеризовались сорта Атласный (плоскоокруглые плоды) и Обериг (сливовидные). Сорта со сливовидной формой плодов превосходили по биохимическому составу образцы с плоскоокруглыми плодами. | Мета. Проведення порівняльної оцінки сортів помідора селекції Київської дослідної станції Інституту овочівництва та баштанництва НААН (ІОБ) з урахуванням різної форми плоду. Методи. Польовий, лабораторний, статистичний. Результати. Оскільки сортові особливості можуть значно впливати на перебіг ростових процесів, у досліді проведено фенологічні спостереження за ростом і розвитком рослин, біометричні вимірювання рослин і плодів, облік урожайності, визначено біохімічні показники плодів з різною формою (плескатоокруглою і сливоподібною). Виділено сорти з найвищою врожайністю, кращими біохімічними показниками, з більш раннім достиганням плодів. Висновки. Серед зразків помідора з плескатоокруглими плодами найкоротший період від масових сходів до початку достигання плодів мав сорт Зорень, у групі зі сливоподібною формою – Миролюбівський. Найвищу врожайність у першій групі забезпечив сорт Атласний, у другій – Хорів. Кращими біохімічними показниками характеризувались сорти Атласний (плескатоокруглі плоди) та Оберіг (сливоподібні). Сорти зі сливоподібною формою плодів переважали за біохімічним складом зразки з плескатоокруглими плодами.

Purpose. Study of winter wheat varieties that were bred at the Institute of Irrigated Farming NAAS through ecological testing in Turkey. Test procedures both in Ukraine and Turkey meet the requirements of the International Union for the Protection of New Varieties of Plants (UPOV). Methods. Field, laboratory ones: structural analysis, quality analysis, statistical analysis. Results. The Exporter Unions Seed and Research Company (ITAS) during 2011–2013 tested winter wheat varie­ties bred at the Institute of Irrigates Farming (IIF) NAAS at four areas of the Central Plateau of Turkey comparing them with local varieties registered in this country. According to the results of these tests the Exporter Unions Seed and Research Company identified Kohana variety as candidate for the state registration in Turkey. Conclusions. The realisation of the innovative product in Ukraine and entitlement to use intellectual property due to licensing agreements is expected. The Institute of Irrigated Farming NAAS continues to create new varieties of winter wheat which can be transferred to other countries for testing for the purpose of introduction and further expansion. | Цель. Изучение сортов озимой пшеницы селекции Инс­титута орошаемого земледелия НААН путем экологических испытаний в Турции. Методики исследований как в Украине, так и в Турции соответствуют требованиям Международного союза по охране новых сортов растений (UPOV). Методы селекции – полевые, лабораторные – структурный анализ, анализы качества, статистический анализ. Результаты. Компания Exporter Unions Seed and Research Company (iTAS) на протяжении 2011–2013 гг. провела иcпытания сор­тов пшеницы озимой Института орошаемого земледелия (ИОЗ) НААН в четырёх местах Центрального плато Турции, сравнивая их с местными сортами, зарегистрированными в этой стране. По результатам этих испытаний компания iTAS идентифицировала сорт Кохана как кандидат для государственной регистрации в Турции. Выводы. Предусмат­ривается реализация в Украине инновационного продукта, а также предоставление права на использование объектов интеллектуальной собственности через лицензионные договоры. В ИОЗ НААН продолжатся процесс создания новых сортов пшеницы озимой мягкой, которые могут быть переданы для испытаний в другие страны с целью интродукции и дальнейшего распространения. | Мета. Методики досліджень як в Україні, так і в Туреччині відповідають вимогам Міжнародного союзу з охорони нових сортів рослин (UPOV). Методи селекції – польові, лабораторні – структурний аналіз, аналізи якості, статистичний аналіз. Результати. Компанія Exporter Unions Seed and Research Company (iTAS) протягом 2011–2013 рр. провела випробування сортів пшениці озимої Інституту зрошуваного землеробства (ІЗЗ) НААН в чотирьох місцях Центрального плато Туреччини, порівнюючи їх з місцевими сортами, які зареєстровані в цій країні. За результатами цих випробувань компанія iTAS ідентифікувала сорт Кохана як кандидат для державної реєстрації в Туреччині. Висновки. Передбачається реалізація в Україні інноваційного продукту, а також надання права на використання об’єктів інтелектуальної власності через ліцензійні договори. В ІЗЗ НААН триває процес створення нових сортів пшениці озимої м’якої, які можуть бути передані для випробувань в інші країни з метою інтродукції та подальшого поширення.

Исследуемые сорта пригодны для безрассадного выращивания в открытом грунте в условиях Киевской области. Период от массовых всходов до технической спелости был самым коротким у сорта Сирмай – 48–51 сутки. Самое большее количество листьев было зафиксировано у сортов Сирмай и Китония – 32,9 и 32,1 шт./растение соответственно. Field, laboratoryones and mathematical and statistical analysis. Results. The authors studied ecological importance of winter triticale varieties of forest-steppe and Polissia ecotopes as determinants of agrobiocenosis in the structural and functional organization of species diversity. It was found that less favourable ecological niche for pests-phytophags is such winter triticale varieties and lines as ‘Slavetne’, ‘AD 256’, ‘Chaian’, ‘DAU 5’, for epiphytoparasites – ‘Vivate Nosivske’, ‘Pshenychne’, ‘Slavetne polipshene’, ‘Slavetne’, ‘Yaguar’, respectively. It is determined that varieties and lines of winter triticale such as ‘AD 256’, ‘Vivate Nosivske’, ‘Pshenychne’, ‘Slavetne polipshene’, ‘Slavetne’ show high biological ability to compete with synanthropic vegetation and form distinct associations of segetal plants. Conclusions. It was found that agrophytocenoses of the studied varieties of winter triticale under the conditions of forest-steppe, Polissia-forest-steppe and Polissia ecotops determined in movements structural and functional organization of species diversity of agroecosystems. | Цель. Выяснить экологическое значение сортов тритикале озимого в формировании видового разнообразия агроэкосистем. Методики. Полевые, лабораторные исследования и математически-статистический анализ. Результаты. Исследовано экологическое значение сортов тритикале озимого лесостепного и полесского экотопов как детерминантов агробиоценоза в структурно-функциональной организации видового разнообразия. Установлено, что малоблагоприятной экологической нишей для вредителей-фитофагов являются такие сорта и линии тритикале озимого, как: ‘Славэтнэ’, ‘АД 256’, ‘Чаян’, ‘ДАУ 5’, для эпифитопаразитов – ‘Виватэ Носовское’, ‘Пшеничное’, ‘Славэтнэ улучшенное’, ‘Славэтнэ’, ‘Ягуар’ соответственно. Установлено, что сорта и линии тритикале озимого ‘АД 256’, ‘Виватэ Носовское’, ‘Пшеничное’, ‘Славэтнэ улучшенное’, ‘Славэтнэ’ проявляют высокую биологическую способность конкурировать с синантропной растительностью и формировать четко выраженные ассоциаций фитосегеталов. Выводы. Установлено, что агрофитоценозы исследованных сортов тритикале озимого в условиях лесостепного, полесско-лесостепного и полесского экотопов в динамике определяют структурно-функциональную организацию видового разнообразия агроэкосистем. | Мета. З’ясувати екологічне значення сортів тритикале озимого у формуванні видового різноманіття агроекосистем. Методи. Польові, лабораторні дослідження та математично-статистичний аналіз. Результати. Досліджено екологічне значення сортів тритикале озимого лісостепового й поліського екотопів як детермінантів агробіоценозу в структурно-функціональній організації видового різноманіття. Встановлено, що малосприятливою екологічною нішею для шкідників-фітофагів є такі сорти й лінії тритикале озимого, як ‘Славетне’, ‘АД 256’, ‘Чаян’, ‘ДАУ 5’, для епіфітопаразитів – ‘Вівате Носівське’, ‘Пшеничне’, ‘Славетне поліпшене’, ‘Славетне’, ‘Ягуар’ відповідно. З’ясовано, що сорти й лінії тритикале озимого ‘АД 256’, ‘Вівате Носівське’, ‘Пшеничне’, ‘Славетне поліпшене’, ‘Славетне’ виявляють високу біологічну здатність конкурувати з синантропною рослинністю та формувати чітко виражені асоціації фітосегеталів. Висновки. Встановлено, що агрофітоценози досліджених сортів тритикале озимого в умовах лісостепового, полісько-лісостепового й поліського екотопів у динаміці визначають структурно-функціональну організацію видового різноманіття агроекосистем.

Results. ‘Karadag’ (k), ‘Windsorski’, ‘Bartoli’ and ‘Karestino’ varieties were trialed during 2012–2014. In the course of trial the peculiarities were studied concerning the formation of plant height, the number of beans and seed weight of vegetable bean varieties depending on the row width in the phase of technical maturity of the beans. It was found that differential of plant height growth was changed to a greater degree in ‘Windsorsky’ variety (+9,3 cm for every 10 cm) in case of row width narrowing from 60 to 20 cm. ‘Windsorsky’ variety had the largest number of beans and the highest seed weight per plant – 8.9 beans and 14.44 g respectively. Seeds of ‘Karestino’ variety were large, their weight per plant made up 10.56 g, the number of beans totaled to 6.6. Conclusions. The maximum influence of feeding area on a height of plants was found in the phase of technical maturity of beans. The largest increase in plant height for every 10 cm of row spacing was observed in ‘Karadag’ and ‘Windsorski’ varieties. The number of beans also is depended on feeding area. With its reducing, the number of beans and their weight per plant was also reduced in all variants. The largest number of beans and the highest seed weight per plant were in variants with feeding area of 1200 cm2 (row width was 60 cm). | Цель. Исследование нормы реакции сортов боба овощного в зависимости от площади питания, в частности ширины междурядий. Методы. Полевой, биометрический, статистический, лабораторный. Результаты. Исследования проводили в 2012-2014 гг. с сортами ‘Карадаг’ (к), ‘Виндзорские’, ‘Бартоли’ и ‘Карестино’. В процессе исследований были изучены особенности формирования высоты растений, количества бобов и массы семян сортов боба овощного в зависимости от ширины междурядий в фазу технической спелости бобов. Установлено, что дифференциал прироста растений в высоту наиболее ощутимо изменялся у сорта ‘Виндзорски’ (+9,3 см/на каждые 10 см) в случае сужения ширины междурядий от 60 до 20 см. Количество бобов и масса семян з растения были наибольшими у сорта ‘Виндзорски’ и составляли соответственно 8,9 шт. и 14,44 г. Сорт ‘Карестино’ характеризовался крупными семенами, масса которых с растения составляла 10,56 г, и формировал наименьшее количество бобов – 6,6 шт. Выводы. Максимальное влияние площади питания на высоту растений обнаружено в фазу технической спелости бобов. Наибольший прирост высоты растений на каждые 10 см ширины междурядий отмечено у сортов ‘Карадаг’ и ‘Виндзорски’. Количество бобов на растениях также зависело от площади питания растения. С ее уменьшением количество семян на растениях и их масса с одного растения уменьшались во всех вариантах. Количество бобов и масса семян с растения были самыми большими на вариантах с площадью питания 1200 см2 (ширина междурядий 60 см). | Мета. Найбільший приріст висоти рослин на кожні 10 см ширини міжрядь зафіксовано в сортів ‘Карадаг’ та ‘Віндзорські’. Кількість бобів на рослинах також залежала від площі живлення рослини. З її зменшенням кількість насіння на рослинах та їхня маса з однієї рослини зменшувались у всіх варіантах. Кількість бобів та маса насіння з рослини були найбільшими у варіантах з площею живлення 1200 см2 (ширина міжрядь 60 см).

Field, laboratory, analytical and statistical ones. Results. Economic assessment of elements of cultivation technology for all lettuce varieties was undertaken considering different sowing time (early spring, late spring, spring-and-summer period and before the winter season), growing techniques (direct sowing, seedling method – planting pots, seedling method – planting containers) and the use of organic fertilizer Dominanta. Calculation of economic efficiency indicators of marketable lettuce production was scientifically grounded, and bioenergetic evaluation of its growing was made. Economic feasibility of seedling method of growing as well as sowing time and delivery of marketable products to the consumer was confirmed. Conclusions. Technological elements of lettuce growing including loose-leaf, butterhead, romaine and stem subvarieties provided increase of marketable products by 13,38; 3,92; 2,07; 3,20 t/ha respectively. The level of profitability of lettuce production was within 83–141% (butterhead) 86–130% (loose-leaf), 185–214% (romaine), 131–137% (stem).

Рассчитано экономическую оценку элементов технологии выращивания салата посевного всех разновидностей при разных сроках посева (ранневесенний, поздневесенний, весенне-летний, под зиму), способах выращивания (безрассадный, рассадный – горшочки, рассадный – кассеты) и применении органического удобрения Доминанта. Научно обоснован расчет показателей экономической эффективности производства товарной продукции салата посевного и проведена биоэнергетическая оценка его выращивания. Подтверждена экономическая целесообразность рассадного способа выращивания, сроков сева семян и поступление товарной продукции к потребителю. Выводы. Технологические элементы выращивания салата посевного, включая листовую, кочанную, ромэн и стеблевую разновидности, обеспечили прирост товарной продукции на 13,38; 3,92; 2,07; 3,20 т/га соответственно. Уровень рентабельности выращивания салата находился в пределах 83–141% (кочанный), 86–130% (листовой), 185–214% (ромэн), 131–137% (стеблевой). | Мета. Наукове обґрунтування агротехнологічних прийомів вирощування товарної продукції сортів салату посівного Lactucasativa L. за економічною та біоенергетичною оцінкою. Методи. Польовий, лабораторний, аналітичний та статистичний. Результати. Виконано економічну оцінку елементів технології вирощування салату посівного всіх різновидів за різних строків сівби (ранньовесняний, пізньовесняний, весняно-літній та під зиму), способів вирощування (безрозсадний, розсадний – горщечки, розсадний – касети) та застосування органічного добрива Домінанта. Науково обґрунтовано розрахунок показників економічної ефективності виробництва товарної продукції салату посівного та здійснено біоенергетичну оцінку його вирощування. Підтверджено економічну доцільність розсадного способу вирощування, строків сівби насіння та надходження товарної продукції до споживача. Висновки. Технологічні елементи вирощування салату посівного, включаючи листковий, головчастий, ромен і стебловий різновиди, забезпечили приріст товарної продукції на 13,38; 3,92; 2,07; 3,20 т/га відповідно. Рівень рентабельності вирощування салату був у межах 83–141% (головчастий), 86–130% (листковий), 185–214% (ромен), 131–137% (стебловий).
