Analysis of land parcel boundaries defined by cadastral measurements

Cadastral measurements of land parcels are conducted under the guidance of territory planning documents designed by resolutions of the Government of the Republic of Lithuania which in turn regulate the collection of real property cadastral data. However, not always boundaries of the measured land parcels correspond to the documents of territory planning and factual consumption of land. This problem becomes obvious when measuring agricultural land which is most frequently formed in land management schemes during the land reform. The aim of the research is to analyze the correspondence of land parcels after cadastral measurements to the documents of territory planning, identifying discrepancies between line lengths and areas of land parcels. Having investigated the correspondence of agricultural parcels to territory planning documents on the basis of the line lengths designed, it was found that higher line lengths occurred after conducting cadastral measurements. Having identified discrepancies between the areas of agricultural parcels and territory planning documents, one can make an assumption that significant differences could be noticed which manifest inadequacy existing in territory planning documents.

The latest land reform in Latvia has substantially altered the structure of use of farmland leading to a great number of very small and fragmented agricultural holdings, yet, in terms of occupied total area and UAA, medium size (10.0-50.0 ha) and slightly larger (more than 50.0 ha) land holdings dominate. In Latvia the number of agricultural holdings tends to decline. On the contrary, the average UAA per agricultural holding rose (by 66%), reaching 23.2 ha in 2010. One can conclude that positive structural changes take place in the agricultural industry – the number of small farms has declined and the number of and the area farmed by large marketoriented farms has risen, thus the difference between the sizes of land holdings that emerged during the land reform and the land areas farmed by agricultural holdings has increased.

The article deals with land consolidation solutions in three rural territories of Latvia, creating perspective monolithic land plots in order to prevent land fragmentation and improve the structure of land properties. Although all three project territories are located in geographically analogical circumstances, established structure of land properties, their infrastructure and location in relation to Riga and other cities and towns prescribes different objectives of land consolidation. The proposed land consolidation methodology could be powerful tool in hands of local municipalities in order to promote development of to rural area in general, agriculture and other sectors.

The aim of the research was to identify the change of abandoned lands in Ūdrija cadastral area of Alytus district. This particular area was selected due to the diversity of land cover objects and because of a good agrarian condition. According to the data of 2010, the cadastral area of Ūdrija had 176 plots of abandoned land with the total area of 61.41 ha. After the verification 179 plots of a land were found, with the total area of 62.84 ha. It can be said that there is a minor increasing tendency of abandoned lands. During field verification as many as 41 mismatches were identified. The mismatch of the data was influenced by two main factors: a two year period between the information of the data set and field verification, as well as errors of the data set. To sum up, the information of verification has changed slightly. It happened because some mismatches were positive (identified new areas of abandoned land), while others were negative (plots of land which were in a set of data were denied during the verification).

This study aims to develop a methodology for determining and calculating the limit size of agricultural land plots that can be leased by individuals and legal entities of the Republic of Kazakhstan. The article substantiates agricultural production after the current long-term lease terms end. The basic condition is the formation of land use, in which there is a close dependence on conditions and factors of production, where land, material resources, and labour are in certain proportions and balanced. The main criteria for determining the limiting sizes of land are: land area, leased to a single entity should not exceed 1/3 of the area of farmland rural district specific administrative area, and the physical person no more than 15% of the area of agricultural enterprises of the same specialization. Emerging land uses should be subject to zonal specialization by natural and agricultural zoning; take into account the minimum thresholds for the area of crop rotation in the crop production sectors and the size of livestock in herds of different types of livestock by the breed composition in the livestock industry.

Declaration data of farming land and crop are analyzed in the article. Ukmergė district is chosen for the more detailed analysis. Statistical data of farmers and other land users are analyzed in the article; the declaration data of farming land and crop are analyzed and mathematical statistical dependence between the declared area and soil productivity index is determined. The results show that there are 2,506 registered farms in Ukmergė district and they manage the area of 18,430.07 hectares. The average parcel size amount to 7.35 ha. The number of farming persons in Ukmergė district as well as in Lithuania have considerably decreased during 7 years period. In 2014, the number of farming persons was by 38.12 percent smaller in Ukmergė district and by 41.24 percent in the whole territory of Lithuania compared to 2007. The comparison of the declaration data of 2011 with the data of 2014 shows that the declared area of farming land and crop in Ukmergė district has increased by 2.46 percent although the number of received applications has decreased by 22.2 percent. During the period of 2011– 2014 the majority of assessed applications were received in 2013, i.e., 99.04 percent of all applications received that year. It shows that the size of land parcels has increased. Cereal crops (oat, wheat, triticale, barley, rye, buckwheat and corn) composed the major part of the declared areas in Ukmergė district in 2013-2014 (48.84 percent of all declared crops in 2013 and 53.79 percent in 2014). The analysed agricultural holding “Egvila” during 2011–2014 period declared the area of approximately 272 hectares annually. This company grows white clover for seed, timothy for seed and cumin. Direct payments are received for all land areas. The analysis shows that farmers generally declared their own land. The analysis of the declared land distribution in Ukmergė district by land property right shows that 75 percent of the declared land are private and the remaining 25 percent are leased either from the state or from natural persons.

The land consolidation project of the parts of Vilkaviškis district municipality, Pilviškiai and Klausučiai elderates, Alksnėnai and Sūdava cadastral area is analysed in the article, the main indicators of the project, the meaning of land consolidation, the need to improve the order of the execution and implementation of these activities are described in the article. The survey was carried out to examine the opinion of the participants of the project regarding the advantages of the proceeding and results of the project as well as some of its drawbacks.

The analysis results of common terms in land management and their interpretations in normative-legal acts of Ukraine are presented. It have been established collisions and significant differences in the wording of even such common terms as a land parcel, a boundary of land parcel, a size of land parcel, etc. The purpose of the study is to identify collisions and contradictions of some key terms used in land surveying and geodetic works, as well as development of concrete proposals for improving and perfection the relevant terms. For this purpose, the following tasks were set and solved: analysis of regulatory legal acts of Ukraine concerning the conceptual apparatus of land management, systematization and generalization of substantiation results of the relevant terms correction need, development of proposals taking into account works content on land management and geodetic works for information provision of the State Land Cadastre. In the course of the study, the comparative method of analysis and the systematization of inconsistencies in the current normative legal acts of Ukraine regarding the terms and their interpretation are used. During the proposals development, known approaches "from general to partial" and vice versa were used. The established disadvantages do not allow unambiguously interpreting and performing such important work as geodetic setting or restoration of the land parcels boundaries, resolution of land disputes between adjacent users of land parcels. Completed summaries of content and wording of the relevant terms justify a need for correction of the terms and additions to their definitions. It was set the features of each term. As a result of integrated approach to solution of the existing problem and systematization of established differences, the general wording and detailed specification of the analyzed terms interpretations are proposed. Knowledge of technological stages for geodetic and land management works provided an opportunity to improve the geodetic information support of the State Land Cadastre. The proposals for correction of the studied terms eliminate existing contradictions, provide an unambiguous interpretation of land management terminology, which leads to the exact execution of geodetic and land management works, and, accordingly, obtaining reliable information for the State Land Cadastre.
