Protected areas on the scale training judges to be partners in conservation

The Philippines is at the point of history where environmental law is at its dynamic best. The challenge is not only for the Legislature to warrant that these laws promote conservation and environmental rights, nor only for the Executive to make sure that these laws are properly implemented, but also for the Judiciary to ensure that these laws are appropriately interpreted. The role of the Judiciary in conservation, therefore, cannot be overlooked nor over emphasized. On 23-26 July 2000, Tangol Kalikasan (a public interest environmental office) in the partnership with the Philippine Judicial Academy (PHILJA) of the Supreme Court, conducted the seminar-conference "The Environment on the Scale: Ipagtanggol and Kalikasan 2 (Defend the Environment)." The conference was accredited by PHILJA as part of the Continuing Legal Education of judges. More than 45 trial court judges and public interest environmental lawyers from various environmentally critical areas in the Philippines participated in the seminar-conference. Many of them have jurisdiction over declared protected areas in the country. The conference was intended not only to enrich the knowledge of the participants on environmental law, but was primarily designed to make them aware of the urgency of the environmental situation and its debilitating impact on the lives and livelihoods of people and communities that directly depend on and defend natural resources. Today, there is a multitude of cases pending in courts, including the Supreme Court that put the environment on the scale. How the Judiciary responds will reflect the quality of justice that we have. Judges are therefore challenged to view the cases they hear and decide from the perspective of the environment and the communities
