О правовом статусе почв Беларуси и его совершенствовании | [On the legal status of soils in Belarus and its improvement]

The article considers the legal status of the soils of Belarus and its improvement. In order to eliminate existing gaps, shortcomings and contradictions in the field of legal regulation of soils, it is necessary to adopt a special Law of the Republic of Belarus "On the use and protection of lands and soils" or an expanded chapter of the same name, supplementing the Code of the Republic of Belarus on Land, in order to create a full and comprehensive legislative framework in areas of protection, multifunctional use, assessment, regulation, control and monitoring of soils and soil cover. When preparing the above legislative acts, one should constructively use the main provisions of the Model Law on Soil Protection, adopted at the XXIX plenary meeting of the Inter-Parliamentary Assembly of the CIS Member States (Decree No. 29-16 of October 31, 2007), the Soil Protection Strategy of the European Union, as well as legislative acts of the countries of Central and Eastern Europe on this issue. / В статье рассмотрен правовой статус почв Беларуси и его совершенствование. С целью ликвидации существующих пробелов, недочетов и противоречий в области правового регулирования почв необходимо принятие специального Закона Республики Беларусь «Об использовании и охраны земель и почв» или одноименной расширенной главы, дополняющей Кодекс Республики Беларусь о земле, с целью создания полноценной и всесторонней законодательной базы в области охраны, многофункционального использования, оценки, нормирования, контроля и мониторинга почв и почвенного покрова. При подготовке вышеуказанных законодательных актов следует конструктивно использовать основные положения Модельного закона об охране почв, принятом на ХХIХ пленарном заседании Межпарламентской Ассамблеи государств-участников СНГ (постановление № 29–16 от 31 октября 2007 г.), Стратегии охраны почв Европейского союза, а также ряда законодательных актов стран Центральной и Восточной Европы по данному вопросу.
