El presente artículo tiene como objetivo presentar los resultados del análisis de la sentencia T-361 de 2017 por medio de la cual se dejó sin efecto la resolución 2090 del 2014 concerniente a la delimitación del complejo de paramo de Santurbán- Berlín (CJSB) y evaluar la calidad de la información sobre las actividades económicas desarrolladas en el páramo utilizada como insumo para la delimitación. Se realizó el análisis de los documentos aportados por la Corte Constitucional, el Instituto Alexander von Humboldt, la CDMB y CORPONOR e información cartográfica publicada por el SIAC. Se pudo evidenciar que se vulneró el derecho a la participación de la comunidad dentro del proceso de delimitación del CJSB ya que no se efectuaron espacios de concertación entre las autoridad ambientales y la comunidad, adicionalmente, el levantamiento de información de actividades económicas fue deficiente y generalizada para todo el complejo sin tener en cuenta la relación e importancia del ecosistema en el sustento de la comunidad. Este análisis servirá como sustento para evitar los mismos errores dentro de los procesos de delimitación futuros.
Mostrar más [+] Menos [-]The objective of this article is to present the results of the analysis of the T-361 judgment of 2017, which disabled the resolution 2090 of 2014 concerning the delimitation of the Santurán-Berlín paramo complex (CJSB) and evaluate the quality of the information related with the economic activities developed in the páramo used as a parameter for the delimitation. The analysis was made using the documents provided by the Constitutional Court of Colombia, the Alexander von Humboldt Institute, the CDMB and CORPONOR and cartographic information published by the SIAC. It was evident that the community participation right was violated within the delimitation process of the CJSB because there were not spaces of agreement between the environmental authority and the community; additionally, the quality of the information about economic activities was deficient and generalized for the entire complex without taking into account the relationship and importance of the ecosystem in the livelihood of the community. This analysis will serve as support to avoid the same errors within the future delimitation processes.
