The new framework of international relations leading to the 1998 EC regulation on driftnet ban in Europe

In 1998 the European Community adopted the regulation No. 1239/98, which practically banned the use of driftnets by EC vessels from 2002. The article will first illustrate the historical development of the 'tuna war', which would provide the historical background for the regulation. After carefully examining the formation of international anti-driftnet opinions, typically represented in the UN General Assembly Resolutions of 1989 and 1991, it will be demonstrated how the once regional dispute over fishery resources was Europeanized by the formation of transnational networks, which were opposed to the use of driftnets by albacore tuna fishing vessels. Finally this case will be discussed in the context of the emerging multi-level governance in EC, which tries to involve European, national and sub- national groups into inclusive decision-making procedures as an alternative to exclusive intergovernmental negotiations.
