russe. Рассматривается исторический путь возникновения частной собственности в мире и на территории нынешней Беларуси. Анализируется развитие представлений о частной собственности в течение XIX–XX вв. Исходя из истории возникновения частной собственности на землю, положений римского права, необходимости повышения заинтересованности крестьян в эффективном хозяйствовании обосновывается возможный в перспективе путь перевода сельскохозяйственных земель в частную собственность крестьян. Вышеизложенные теоретические положения являются обоснованием следующих предложений. Предлагается введение давностного срока владения землей, которое предшествует приобретению права частной собственности на этот земельный участок. Для перехода от владения к частной собственности на землю предлагается ввести 15-летний временной интервал. Крестьянин (фермер), владеющий 15 лет участком, затем становится (он или наследник) его собственником. В течение указанных 15 лет земельные отношения регулируются существующими нормами.
Afficher plus [+] Moins [-]anglais. In a course of the research there was studied the historical path of the emergence of private property in the world and in what is now Belarus. The evolution of concepts of private property during the XIX - XX centuries was analyzed. Based on the history of private ownership of land, the provisions of Roman law, the need to raise interest of peasants in the effective management, it was shown a possible in the future way of the transfer of agricultural land to private ownership of peasants. The foregoing provisions are theoretical justification for these proposals. It was proposed the introduction of tenure limitation period, which precedes the acquisition of private ownership of the land. To move from ownership to private ownership of land is proposed to introduce a 15-year time interval. The peasant (farmer), who holds the land area 15 years, then becomes (he or heritor), by its owner. During these 15 years of land relations are governed by the existing rules.
