Knowledge as the productive factor of the 21st century: What do organizations think about the intellectual property of indigenous peoples? | El conocimiento como el factor productivo del siglo XXI: ¿qué piensan las organizaciones sobre la propiedad intelectual de los pueblos indígenas?

This article is an introduction to a topic that is so unknown and yet so fundamental: what risks and opportunities do TRIPs (Trade-Related Intellectual Property Rights) represent for indigenous populations that are bearers of knowledge and natural resources? To answer this question, the authors delve into the meaning of intellectual property and knowledge as the fourth factor and first in order of importance for the generation of wealth in today's world, identify the significance of this factor, contextualize it in the framework of international agreements-contracts (Uruguay Round, WTO, Doha Declaration, FTAA/CAFTA) and consider the WTO as a non-state organization but with rules that have a character of unavoidable compliance by States - in this case in relation to TRIPs. In the end, they offer a framework for self-reflection for indigenous communities and the organizations that work with them.

Este artículo es una introducción a un tema tan desconocido, y a la vez, tan fundamental. ¿Qué riesgos y oportunidades representan los TRIPs (Trade-Related Intelectual Proterty Rights) para las poblaciones indígenas portadoras de saber y recursos naturales? Para responder a esta pregunta, los autores hurgan en el sentido de propiedad intelectual y en el conocimiento como el cuarto factor y primero en orden de importancia para la generación de riqueza en el mundo de hoy, identifican el significado de ese factor, lo contextualizan en el marco de los acuerdos-contratos internacionales (Ronda de Uruguay, OMC, Declaración Doha, ALCA/CAFTA) y ponderan a la OMC como organización no estatal pero con reglas que tienen un carácter de ineludible cumplimiento por los Estados- en este caso en torno a los TRIPs. Al final ofrecen un marco de auto reflexión para las comunidades indígenas y para las organizaciones que trabajan con ellas.
