Decertification: the role of the first-line supervisor

Decertification is defined by the National Labor Relations Board (NLRB) as a procedure whereby unionized employees vote to take away their union's right to act on their behalf as an exclusive bargaining agent. Filing a decertification petition with the regional director of the NLRB is the first formal step in the decertification process. The process should be initiated by employees; it is not the role of management. After the petition is filed, the NLRB conducts a decertification election and informs both the union and management about what is involved. During the pre-election campaign period, supervisors must be careful to avoid violating the law concerning unfair labor practices. Specific practices that supervisors can and cannot engage in during this time are outlined. Suggestions are also provided to help supervisors maintain a nonunion environment and to keep employees satisfied in the event that the union loses the decertification election.(aje)
