El dominio de las aguas en el derecho indiano y su evolución por influencias del derecho civil en la América española

Resulta indudable que el Derecho Indiano, surge de los principios generales del Derecho Castellano, que es en definitiva, el derecho aplicado en el nuevo continente, que en razón de su extensión y diversidades culturales, no tenía una estructura política y legislativa única, por lo cual, fueron de aplicación las instituciones del Derecho de Castilla, normas éstas que tendrían en el tiempo, la necesidad de adaptarse a la idiosincrasia y problemática de estas latitudes. El dominio de todas las aguas, para el derecho de Castilla, pertenecían al rey y este las declaraba de uso común. Para los aztecas y los incas, las dos civilizaciones originarias más desarrolladas, todas las aguas y tierras eran de propiedad y gobierno del Inca, quien las distribuía tras cada conquista territorial. El derecho indiano, traslada el dominio de tierras y aguas, de manos del Inca al Rey, constituyéndose los realengos sobre los cuales el soberano ejercía plena autoridad. La incorporación de principios contenidos en el derecho civil español, francés, alemán, inspirados a su vez en el derecho romano, modificó en diversas formas la cuestión del “dominio de las aguas”, introduciendo la calidad de aguas “públicas” y “privadas”, las que a su vez, volvieron a limitar el dominio privado sobre las aguas. Este trabajo, pretende reflejar estos movimientos o tendencias.

Undoubtedly, the Indian Law, arises from the general principles of Castilla law that is ultimately the right applied in the new continent, which because of its extent and cultural diversity, did not have a unique political and legislative structure, which is why, the institutions of the Law of Castilla were applied, norms that would have in time, the need to adapt to the idiosyncrasies and problems of these latitudes. The domain of all the waters, for the right of Castilla, belonged to the king and he declared them of common use. For the Aztecas and the Incas, the two most developed original civilizations, all waters and lands were property and government of the Inca, who distributed them after each territorial conquest. The Indian right, transfers the ownership of land and water, from the Inca to the King, constituting the crown property on which the sovereign exercised full authority. The incorporation of principles contained in Spanish, French and German civil law, inspired in turn by Roman law, modified in various ways the issues raised of ʺdominion of watersʺ, introducing the classification of ʺprivate waters” or “public waters”, which, in turn, once again limited the private domain over the waters. This work, intends to reflect these movements or trends.
