[Juridical nature of ecological rights]

The aricle, concerned the situation in Ukraine, deals with the issue of rights and freedoms of a man and a citizen as signs of a jural state. In the base of the natural right studies lies the idea that all the legal norms are to be based on the objective principles independent of human will. The Constitution of Ukraine provides for one of the ecological rights, in particular the right for the environment safe for life and health that means the possibility and necessity of the existence of a man in such conditions which do not affect the state of health. Examples are given of the human rights determined by the Law of Ukraine "On protection of the environment". It is stated that the issues as regards separating the rights which require legislation fixation and those that do not need that remained unsolved yet
