Agriculture is characterized as a sector which influences the natural environment by means of using natural objects and is subject to effect of the whole complex of natural factors (solar radiation, winds, precipitation etc.). Intensification of the agricultural production enhances an anthropogenous load on the environment. Problems of protecting the land and preventing of degradation thereof from the point of view of the ecological legislation are considered. The article also deals with the active participation of the state, a constitutional right of which, according to the Constitution of Ukraine, is "the provision of ecological safety and maintaining the ecological balance on Ukraine's territory, overcoming the consequences of the Chornohobyl catastrophe, preserving the genetic pool of the Ukrainian nation". The legislative protection of the land in Ukraine's legislation fixes a provision that the land in this country is the main national treasure, which is under the special protection of the state, it is an element of the environment which requires a constant legislative protection. It is noticed that the legislative protection of the land as an object of the natural environment is directed on restoring, preserving and raising the soil fertility, improving useful properties of the land, banning polluting, deteriorating, spoiling thereof.
