The World Bank inspection panel
Shihata, Ibrahim F. I.
In 1993 the World Bank created an inspection panel to investigate complaints about its own operations. This initiative - the first of its kind for an international organization - is the subject of this publication. As general counsel of the World Bank and one of the main architects of the initiative, the author is in a unique position to analyze the implications of this step for the World Bank, for other international organizations, and for international law. After outlining the developments leading up to the Bank's decision, the author interprets the resolution creating the panel, addresses criticisms of the initiative, and examines the panel's potential costs and benefits for the Bank and its members. Of particular interest is the discussion of the influence that the panel may have on the progressive development of the law of international organizations, especially regarding access by private groups to international remedies. Detailed annexes provide, in addition to the text of the resolution setting up the panel, policy statements and Bank procedures that may form the basis for cases before the inspection panel.
