After some disquisitions about the contractual and legal origin of the pre-emption and about the difference between the institutes in law of the pre-emption and the right of option, the Author complained about the absence of more details in this law. Particularly, this occurred after the coming into force of the law 28.02.97 n.30 (ex Decree 31.12.96 n.669). This provides the recording of the promise to sell as well as the recording of the following definitive acts.
