This annex to a larger study provides insight on seed acquisition mechanisms. India’s obligations within the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), Article 27.3 (b) will affect acquisition. Relevant within the ‘sui generis’ context are the Protection of Plant Varieties and Farmers’ Rights Act (2001) (PPVFR), and International Union for the Protection of New Varieties of Plants (UPOV). Rates of farmers saving local varieties of seed have been greatly exaggerated, and a coordinated effort is necessary to ensure the goals of India’s sui generis option are achieved.
