The pet from the perspective of the multi-species family and its introductions into the brazilian legal ordinance | La mascota bajo la perspectiva de la familia multiespecie y su inserción en el ordenamiento jurídico brasileño

The article deals with the new type of family, based on the principles of plurality and affection listed in the Federal Constitution of 1988, the multi-species family, which includes both human members and their pets. The Brazilian legal system classifies animals as goods to be shared in the event of marital dissolution. Currently there are numerous questions about pet custody, and the awareness that animals are sentient beings, taking into account their welfare. Through the dialectical method, the work aims to draw a comparison between the new type of family and the limits of current Brazilian law to protect and introduce pets into the family group and the possibility to pass a specific law, the Bill nº. 1.365/2015, which aims to be the normative basis for definitions of custody and responsible ownership of pets in the event of marital dissolution. For the selection of the bibliography we used the monographic method. The work was divided into two main chapters. The first will examine the evolution of the family, highlighting the multi-species family. The second analyses the Brazilian legislation and the protection given to the pet in case of marital dissolution.

El artículo trata de la nueva modalidad de familia, con base en el principio de la pluralidad y afectividad enumerados en la Constitución Federal de 1988, la familia multiespecie, que agrega tanto miembros humanos como sus mascotas. El ordenamiento jurídico brasileño clasifica a los animales como bienes a ser compartidos, en caso de disolución conyugal. Actualmente, hay innumerables cuestiones en cuanto a la custodia de la mascota y la concientización de que los animales son seres sensibles, teniendo en cuenta su bienestar. El trabajo pretende, a través de lo dialéctico, hacer un cotejo entre la nueva modalidad de familia y los límites de la actual legislación brasileña para proteger e insertar los animales domésticos en el grupo familiar y la posibilidad de aprobar una legislación específica, el Proyecto de Ley nº 1365/2015, que pretende ser la base normativa para definiciones en cuanto a la custodia y posesión responsable de la mascota en caso de disolución conyugal. Se utilizó el método monográfico para la selección de la bibliografía. Se dividió el trabajo en dos capítulos principales. En el primero, se analizará la evolución de la familia, resaltando la familia multiespecie. En el segundo, se analiza la legislación brasileña y la protección dispensada al animal doméstico en caso de disolución conyugal.
