Girişim Sermayesi Yatırım Ortaklığı Sisteminin İslam Hukuku Açısından Değerlendirilmesi | Evaluation of Venture Capital System in terms of the Investment Trading Processes and Islamic Law

Risk sermayesi, ileri teknolojiyi finanse eden dinamik bir sistemdir ve bir ülkede büyük istihdam oluşturan veya ihracat potansiyelini artıran bir faaliyet olarak ifade edilebilir. Girişim ise yeni ve gelecek vaad eden bir iş koluna, kullanılan teknik ya da teknoloji ile giriş yapmaktır. Girişimci, genel olarak genç, yetenekli, çalışan ve büyük bir kâr potansiyeli taşıyan fikirlere sahip olanlar insanlardır. Kur’an-ı Kerim’den pozitif bilimin önünü açan çeşitli örnekler verilebilir. Hz. Yusuf’un yönetimi, Hz. Sü-leyman ve rüzgâr enerjisi gibi mucize diye nitelendirilen çeşitli konular girişimcilik kavramına örneklerdir. İslam hukukunda risk sermayesinde kullanılan ortaklıklar, istisna akdi (eser sözleşmesi), inan ortaklığı (anonim şirketi) ve emek-sermaye ortaklığıdır (mudarebe). Bu çalışmada, bu ortaklıklar, Kur’an-ı Kerim ve İslam tarihinden örneklerle temellendirilmektedir. Özellikle emek-sermaye (mudarebe usulü) ortaklığı, en temel işlem unsurudur. Ekonomik bakımdan kalkınmış ülkeler, yeni dünya düzeninde faizli kredilere alternatif olarak risk sermayesi yöntemine yönelmiş bulunmaktadır. Bu model, İslâm’ın asırlar önce uyguladığı emek-sermaye ortaklığıdır. Çalışmada, yine Türkiye’de risk sermayesi uygulaması ve varlık kiralama şirketi (VKŞ) ilişkisi gibi konular da değerlendirilmiştir.

Venture capital is a dynamic system that finances advanced technology. It can be expressed as a field of activity that creates great employment and increases export potential. Entrepreneur-ship is to enter a new and promising business line with the technique or technology used. Entrepreneurs are generally young, talented, working people who have ideas with great profit potential. Various examples that paved the way for positive science can be given from the Quran. Some subjects that are described as miracles such as Hz. Yusuf's management, Hz. Suleyman and wind power are examples of the concept of entrepreneurship. The partnerships used in venture capital in Islamic law are contract of exception (work contract), faith partner-ship (joint stock company) and labor-capital partnership (mudaraba). In this study, these partnerships based on examples from the Quran and Islamic history were evaluated. The labor-capital (mudaraba method) partnership is the most basic process element in the system. Economically developed countries have turned to the venture capital method as an alternative to interest-bearing loans in the new world order. This model is the labor-capital partnership that Islam applied centuries ago. Also in the study, venture capital applications and venture capital system (VKS) relations in Turkey was evaluated.
